I have a theory about that actually. Remember it's just a theory and not any kind of spoiler:
The Joker is a member of the Scarecrows gang in the beginning of the movie. Something happens and Dr.Crane hits him with a lethal dose of his fear toxin, which drives the already unstable Joker off the trolly. He gets away and mutilates his face as a result, becoming Nolan's Joker. Joker kills the Scarecrow, deciding he has to take revenge on everyone who he percieves as having wronged him, the cops,Harvey Dent and The Batman.
HANGS! I think that it is an awesome way to show how truly evil the Joker is. Hang the guy who is supposed to be real scary. Well I hope this info is correct otherwise I am gonna look like a total ass. But I did get the guy's e-mail so hopefully more to come!

There's no reason Nolan can't change his mind on the no killing villains thing.
I think it's a great idea whether he lives or dies. Face it we don't really need to keep Scarecrow around for movie 3. Finish him proper.

But I think the fact that it's Scarecrow gives it just the kind of flair Joker would love. Hanging the villain who already wears a noose around his neck.
