Well the thing is Spider-Man hasn't fully returned. That's why there's a Venom, Morbious and Black & Silver movie in the works and they are not included in the MCU.

no one has really explained where that line is

Spider-man is in the MCU , and Vulture and Shocker , and what looks to be Scorpion are in Spider-man , so I assume that makes them part of the MCU

I think they are shared rights. With the villains/supporting characters whoever adapts them first kinda owns them, since I doubt they (Sony) would want to make their own version of Scorpio which would just lead to confusion. Same thing with Marvel, they probably wouldn't touch Venom, Black Cat, Morbious, Carnage and Silver Sable after their non mcu films are released.

Marvel need to start making "Marvel Two In One" films starring the Thing and someone else. Make Ben Grimm the everyman that he was in the comics and make him as lovable to audiences as he was in the comics.

That would also be a way for other heroes to share the spotlight and get more development than they might otherwise get in a team film.
