I doubt the character was ever tied to the Spidey franchise, but Sony might have taken issue with the name, and possibly still do. In other words, Sony's partnership with Marvel Studios probably changed nothing wrt the usability of Jessica Drew. Also, we don't know what the new agreement entails.
As for her being in AoS...I suppose it would make sense, what with all the focus on Hydra atm. I don't think she should be a mainstay on the show, though. At her best, she was more of a supernatural character. As a spy, she's a complete snoozefest, and there's little to separate her from other characters.
