Discussion: State Rights

There's a difference between MLK and a governor of a state. A good shepherd doesn't incite a riot. A good leader is a diplomat as well as a problem solver.

:thing: :doom: :thing:

What if a state has a stupid law, like anti sodomy laws, would the courts overturning that be bad?
No, the courts have the right to overturn those laws because anti-sodomy laws violate the United States Constitution and states do not have the right to pass a law that directly violates federal law. Those laws shouldn't have been enacted in the first place.

The Ninth Amendment grants either the state or the people the right to privacy. Along with various statutes and court rulings that enforce that right.

Or slavery or segregation or the right to vote?

:doom: :doom: :doom:
Slavery was legal within the Constitution however until the end of the Civil War. It was wrong, but it did eventually get fixed. Segregation on the other hand is not and never was. We had a horribly racist Supreme Court that allow such a horrible thing to occur

No there isn't a difference. These are both instances of people demanding that the rights that are entitled to them within the Constitution are enforced and protected. You can't just ignore certain rights. Doing so sets the dangerous precedent to being able to do it over and over and over again with it being worse the next time.

Alcohol being illegal was in the Constitution for a time being.....

So what you're saying is that instead of addressing the differences in policy through diplomacy, Texas should just go ahead and start a war with the U.S.?

What the...what the hell are you talking about?

There is nothing being said about Texas trying to secede or start a war with the federal government. Nothing at all! I mean seriously, are you just browsing through and ignoring certain parts of what I have been saying?

The Constitution grants the states, every single one of them, certain levels of sovereignty. When a governor stands up and asserts the rights of sovereignty that his or her state is entitled to, that doesn't mean that they're trying to start a war with the federal government or secede from the Union. We all have the right to demand that our rights, whether it be for the individual, the group, or the state, be protected and enforced.

I think you are the one who is ignoring things. Are you naive? Perry is rattling his saber.

"If you don't do what we tell you to do regarding tax dollars and stimulus plans, we'll secede from the Union."

What do you think he's doing? Why would they pass a bill reasserting that right?

Saber rattling. Treasonous if you ask me. And not what you want from a leader.

Btw, I live in Texas. Where do you live?

He is not saying "If you don't do what we tell you with stimulus money we are leaving" he is saying "if you overstep your authority and force us to do what you say we are leaving" - and he is exactly right to do so.

Again, I love how people believe that saying "look at the Constitution" is an act of treason :lmao:

Perry...not I like Perry too much was appealing to the right with those comments...

Perry is only saying what people think in those moments when they are alone.

He stated, that the unfair financial burden on his constituents needs to be addressed.
If it continues...a little comment like this may become something far more stern and serious.

It is a politicians responsibility to warn a governmental body when its doing wrong...or even wrong if he believes it to be.

If he was running around yesterday saying grab your guns...we are leaving now. Yes..irresponsible because he did not attempt to resolve the issue first thru numerous attempts and means

He is not saying "If you don't do what we tell you with stimulus money we are leaving" he is saying "if you overstep your authority and force us to do what you say we are leaving" - and he is exactly right to do so.

In other words, it's "Screw you guys, I'm going home". Gotcha

I'm pretty sure his position has been "looked over" prior to now. He's just trying to pick a fight that will do nothing but harm my state and my country.

Will it have been worth it when Texans and NY'ers are killing one another? Will it have been worth it when our country is ripped apart?

You have the right to do alot of things. But should you do them?

Proximity doesn't mean you know what you are talking about.

I partly agree with you: I think that a certain portion of this charade is driven by a childish disapproval for Obama and his plan.

On the other hand, I do recognize that it is also a serious state's rights issue and should not be dismissed so quickly as merely a childish ploy.

Side-note: Let them secede. Who cares? :oldrazz:

No. In other words "if you guys cross a line, screw you guys, I'm going home" - which is perfectly reasonable. The states are not slaves to the Federal Government.

I'm pretty sure his position has been "looked over" prior to now. He's just trying to pick a fight that will do nothing but harm my state and my country.

:thing: :doom: :thing:

If the government abuses its relationship with the states, the right thing for the states to do would be to reject.

Proximity doesn't mean you know what you are talking about.

No, but it sure does flavor my responses with relevancy. I care more about Texas than you do and when my elected official starts giving ultimatums to my country, it gets me worried.

I agree with you there Frnaklin...
I am not a big fan of Perry...he seems to be a typical politician...
He took advantage of the tea parties to make himself sound more like an ordinary citizen...

But this is bigger than simply a Texas issue. This is an American Federal Government issue.

I'm not a big fan of Hutchison, but right now I'm seriously considering registering as a Republican so I can vote in the primaries.

:D

I thought that was Chuck Norris.
