There's only one problem if the smile-scarring occurs DURING TDK, as Jett (and others) have said. (This also refers to Miranda/Anjow reports that talked about the zipline accident, though I'm sure they weren't sure if it was actually being done or not.)
The problem is this - if Nolan grounds it in realism, how did the scars heal that fast? The Joker photo we got on IBIHDT.com shows massive scar tissue that's been healed for a while, even years. If he gets those things during TDK, there's no way they heal up in enough time for him to apply lipstick and then go about his crime spree.
Either TDK takes place over the course of several years, or he already has them when the film opens.
If its true I think that could easily fall into the realm of suspension of disbelief. If he did get injured I'd expect him to go back into hiding and regroup for a while, then launch this big terrorism campaign
