Hmm...if he is pleading the Fifth it means he and his attorneys believe there is a pretty good chance that he is going to be prosecuted. Trump has already signaled he will pardon his people if they are prosecuted. But there in lies the rub. If he is pardoned, he can no longer plead the Fifth. Which means his testimony can be compelled in the impeachment hearing that inevitably follows Trump pardoning anyone related to this scandal.
No. No its not. The Fifth Amendment is the right to not be used as "a witness against" yourself," or, in other words, the right to not have testimony compelled. It doesn't mean "I'm guilty so I am choosing not to answer." It means "the government cannot force me to testify against myself."
If I have a client whom I know for a fact is innocent and I have 50 witnesses corroborating his innocence, a video tape confirming his alibi, and a DNA test proving my client is 100 % innocent, I would STILL advise my client to take the Fifth. Testimony, from even an expert witness or cop who has testified a thousand times, is imperfect. A trial attorney's job is to sniff out imperfections and twist them to his advantage. Why would you give the government the opportunity to do that to you?
