Whoa, I never knew that there's a Toby clone. Come to think of it, Jake Gyllenhall would be perfect for the Scarler Spider(if only he bleached his hair and shaved).

I hope the clone saga never makes it to the movies but the only other actor that could look the roe that I know of besides Jake is Milo Ventimiglia from Heroes here's a few pics.

I would really like for them to avoid the clone saga, although I am a fan of the Reily incarnation of Spidey. I agree though that it would be nice to imagine Jake Gyllanhall in the role with a bleach blonde look. And with the slight differences in Maguire you could say storywise than the cloning of Peter wasn't an exact science.

Milo Ventimiglia has the look in the face too, but his build is too different.

Maybe an unknown actor who works as a Toby impersonator might work. That, or a black version of him.

Ok, so Jake won't be much of a "scarlet-spider", but why don't you look in the thread "Tobey's replacement for Peter/Spiderman". I hope they have good actors for Ben Reilly.
