That was going to happen either way. The Superman film franchise is on indefinite hold due to the legal issues associated with the charater. In 2013, the copyrights to the character as published in Action Comics #1 will go bact the Siegel and Shuster families and that could divide the charater as we know him unless the WB can somehow come up with a settlement that can merge the rights again. If that doesn't happen it could be very possible that we may not see another Superman film in our lifetimes or some other company (like Disney/Marvel) may get a portion of the rights. This issue was something that I have been bringing up constantly and a lot of fans have been in denial about it.
Disney, Marvel, or any other company will never go forward with a Superman movie. Even if 2013 roles around, WB/DC owns way too much of Superman for the Siegals/Shusters to be dumb enough to try and sell it off. Unless you want to see a Superman that doesn't fly and jumps around among other things. Not so Super.
But if they were to buy the rights to what the Siegel Family owns they could publish their version in another medium like a comic book or a newspaper strip. Remember Captain Mar-vel.
If the family chooses to do indie, they may have to start all over again, and that would be a failure. Marvel is not gonna pay up for Superman, that's for sure. And then they would have to figure him and his world into the Marvel universe, and that's a pain. Plus, they have enough characters already.NO!! But DC owns certain characters like Brainiac, and even the modern Superman logo.

You don't understand what I said. They would buy the rights to Superman (that DC doesn't own). Then they would publish their own version of the character (to maintain the rghts). That way, it would muck up any DC/WB attempts at restarting Superman. This is just like DC's Captain Marvel not being able to be featured in a comic of the same name.
