Yeah, right. The Oscorp tower was almost in The Avengers and it's totally impossible that that is just a cover up story

good point but at the end of the day, if Spider-Man will join The Avengers or just do a cameo, nobody could care less if the Stark Tower was seen in TASM or not

What if they end up making Spider-man look like a *****e for not showing up the first time lol. The Avengers would definitely have to take place before Peter became Spider-man if he makes it in the next one.
Now that I think about it, doesnt TASM take place in the year 2014?
