I'll step in as Devil's Advocate here and say it's not just the fact that Paris is a well-known celebrity. She's also an heiress.:o
 
I'm sorry man, but your post is simply not the truth. It's not. She is getting harsher treatment because she is paris hilton, and that is the reason. If her name was Joe Blow she would have gotten a week in jail, and according to the law, the sheriff has the authority to do it. They even freaking quoted the law last night on the news.

It was on Abrams new show. the normal sentence would have been 5 to 7 days, and the sheriff has the authority to do this, and he does it every single day.

As Jag has said the usual in MOST STATES for violation of Parole ,inciting a DUI is 60 days or more. If you're lucky, you'll serve less time incarcerated and then be placed on Parole or ACD. Thats Unsupervised Parole. Which extends your "sentence" to a full year. No matter what. Period.

The Sheriff only has the authority to release her from what we here in NYC call "The Tank" under the grounds that she has no forward progress in projection. Meaning, she is not being projected to see a judge within the time that she is in "the tank". After such, she would be transported to what is called "Central Booking". Where she will see a judge, and then she will be sentenced. THEN she will be taken to a facility that the "Sheriff" has NO authority over what so ever.

You are sorely mistaken if you think she's being treated the way she is because of who she is.

She was given LIGHT treatment because of who she is and should be thankful that they didn't place her in for 5 months. Which would be the usual outcome of someone violating their Parole....TWICE.

Exactly, which is pretty much what I've been pointing out; judges have the discretion to make whatever call they want to within their legal boundaries for each individual case. There is not a one size fits all sentence, nor are their one size fits all rules for every inmate regarding having a sentence commuted for whatever reason. It is up to the discretion of the judge (or a jury, in the instances where a jury might be involved in sentencing).

You know how many ex-cons would be flooding the streets right now?

You think people in prison act up all the time? They do their best to keep in the good graces of the facility almost 24/7. Thats if they WANT to -attempt- a Parole appeal.

My friend Jason who got a DWI and got caught driving without his license. He got 60 days and had to serve two full weeks of it PLUS community service and probation. And I know that judge. Had my friend been a snot towards him over it, he'd have gotten the full sentence. I told ya....45 days is not an uncommon sentence.

what was his prior criminal record? How far over the legal limit was he? And it varies from state to state. I can't say for sure if a week is normal in every state, or just her district, but I know that i nher district at least, the norm is a week.

As for the rest of your post, I think your just assuming facts, without knowing them to be true, and then using them to back up your argument. I watch the news a lot, and I watched the coverage on this. I heard several people who work in the courts say her sentence was way harsher than any other case they ever heard of, where the same crime had been committed.

I heard zeroe say the opposite.

She showed up to jail when she was told, and as far as we know she got no infractions, and didn't disobey the officers while in jail.

As far as her being released, that's a legal matter to be worked out in the courts. It's not like she escaped without being authrorized to do so by the jail. The jail released her, and that can't legally be held against her. That would be like holding somebody's motion for an appeal against them. It would be a violation of due process.

I ask you this. What is the name of the law in Wisconsin, which states a person's medical background can not be used to discredit them as a witness in a court of law?

I thought the US had some constituional thing about cruel and unusual punishment. Cos I cant think of much that is a more Cruel punishment then sending someone inside, letting them go out tagged and then a couple of days later saying "sorry, although you turned up to jail as you should, behaved for the admittedly pathetic amount of time you were in chokey, and havent broken the terms of your tagged period, we have to send you back cos the judge has thrown his toys out of the pram"


and i do find myself asking that if it wasnt Paris Hilton (about whom there seems to be a developing cult of hatred), would the Judge have done his pieces?
