i highly doubt they'd forget something like that. even still, it'd also be the usband/boyfriends duty to remember to ask as well.

Why not? I'd think that were a rather important aspect of the subject of rape and rape deterrence.

I'm not trivializing it by saying that - I'm putting it succinctly. Sex is not a necessary means to attain the intended dominance the rapist is looking for, but that it is the prime choice (making it rape rather than simple assault) due to the fact that it is about as great a violation of a person's body as you can conduct.

Legal terms

legally anything that is construed as unwanted contact in a sexual manner is defined as sexual assault and rape is forced penetration, though states do differ between what can be charged as sexual assault or rape. However, like another poster said, many people (myself included) consider rape to be any kind of unwanted sexual contact.

Isn't rape penetration without consent. So if the guy still has to penetrate the girl in order for this thing to work, isn't it still rape? So how is this a deterrent?

Seriously - if this is supposed to somewhat of a solution regarding the spread of HIV/AIDS, then it's piss-poor.
