That's not actually accurate. Sony previously did have animated television rights for Spidey. That changed after a renegotiation (that's how Spectacular was cancelled). The issue with Fox seems to be that they didn't have television rights (Marvel produced multiple X-Men animated shows without Fox), but the somewhat unclear contract prevented Marvel from doing any live action Mutant stuff on television (ahem, Mutant X lawsuit).
This seems soThe Spidey television rights aren't quite that simple either. The deal for animation didn't give Marvel live action television, hence the newspaper in Daredevil not being the Bugle.
Incredibly stupid. What's the point of having the same executive producing team from the movies as the EP's for the shows if they're not tied to the movie universe?! A waste of time just like the DC shows not having any connection to the movies.
I don't particularly think they need to partner with Marvel to make a competent connected universe - Marvel Studios isn't the end all, be all and their universe isn't without it's flaws either.
Fox, specifically with the X-Men franchise, just needs to lay out a plan which they haven't other than vague references. I guess we'll see once Deadpool and Apocalypse shakes out but right now they're kind of aimless, or at least, keeping cards close to the vest which isn't particularly a confidence booster to fans.
