If he is indeed in the film, how would he be portrayed on screen?
Perhaps he asserts himself as the new crime kingpin in the power vacuum left by the events of TDK. Maybe he hires/recruits Bane to be his own personal "Batman" to deal with any perceived threats to his turf-- including Batman and Catwoman. I did mention this in the Bane thread, but wanted more people to think about that possibility and respond, or just offer up their own ideas about how Falcone could be utilized.
Of course the role could be inspired by the Holiday Killer storyline, but I think Falcone may be a better fit as the man who brings Bane to Gotham, as he is somebody who could benefit from his presence and afford to pay him what would surely be a heavy fee for his services.
