Gamestop sued for misleading used game ads

Depends on the game. I'd rather get a PS2 game from Gamestop for $9 than try to buy it for $10 + shipping and handling on Ebay. Plus, I find myself a little more willing this gen to buy used games since PS3 BR disks have scratch resistant coating. With DVD's, I'm very hesitant since I've been burned on one not working a few times. With a PS3 game, unless someone took a knife to it, I know it's going to work. So if the games $40 used and $55 new...I may be tempted to save that $15. Especially if I was on the border about buying the game in the first place.

However I'm totally with you on the $54.99 Used, $59.99 New crap. $5 off a new release that's already been opened and used, and whatever bonus that comes from it being new (like with Dragon's Age giving you a voucher for a $15 DLC with it), it's just a rip off to buy it used in that case.
 
Hell, I thought an NPC hawking extra content in-game is a rip off.

That is the worst load of crap that Gamestop tries to pull. They finally tried to do this to me and I'm never buying a thing from them again. :cmad: I just wanted to buy Infamous... thankfully Best Buy had like 10 copies brand new.

Ok, no that is not fair :funny: Ha I work there and if you come in buying a new game but we're out of stock of sealed new copies, we give you the display case that you bring up to the register but bring out the disc we put to the side. The only thing we did is take them out and put them in an envelope. And no one is ever forcing you to buy it either, technically we're just sold out if you end up being offered the display copy. Interestingly enough someone came in last week buying Dragon Age DLC, but came right back 15 minutes later saying he meant to buy the actual game and not the add on content. And I live in the Bay Area too, so Hayward is literally 10 minutes away from me :funny: Maybe it was the same guy :lmao:

The display copy should be sold at a discount, it's as simple as that. Once that seal is broken it's a used game.

I also think the fact that Gamestop feels they need to open one to have a copy on the shelf is dumb. They never seem to have enough copies of anything, and yet they decide to open one of the few they have just to put a box on display? :whatever: They have those mock ups on display for a few months before a game comes out, why not just continue using those?

I was always looking for an excuse not to go back to Gamestop, it's a crappy place, so whatever. Best Buy and Target always have enough copies of games, and I don't feel like I'm walking into a porn store when I go in... time to go drink some whiskey and forget about all of this.

I don't know. Have they ever given a reason for that? I can see where they might do that in order to prevent theft. Somebody steals from them, all they get is an empty box. I suppose, though Gamestop COULD put the games in a locked cabinet like they do in ,say, K-mart, but then I suppose gamers would then whine about not being able to read the details on the box. No win for Gamestop.
Don't get the idea I'm being an apologist for Gamestop, I'm not. I don't shop there anymore either. I get all my games online anymore. I just think we need to look at it from their perspective, to be fair.
As far as this guy suing them, I agree he's an idiot from the get-go, it was well advertised that the DLC content in Dragon Age was free only with a new copy of the game months before it's release.

Gamestop probably should let people know, but that'd be expecting too much. Half the time the employees know less about games than any of us here do. More than half the time, the employees at gamestop don't even know what deals are on or off at the time.

In the perfect world, they'd let people know...but c'mon. Gamers need to do research nowadays. I'd probably blame Bioware more than I'd blame gamestop, for not advertising the free dlc as "buy new and get...".

The thing the Attorney General of New York Andrew Cuomo subpeonaed Gamestop over a little while ago had way more merit than this.

I don't think there was fine print to be read.

He just didn't do his homework. If you care about stuff like DLC and things, and want to get more bang for your buck...people have to do their homework.

The Dragon Age stuff can be confusing, though. I spent alot of time trying to be sure I understood how each DLC was making it's way without extra charge, or which had to be paid for.

Well there is a disclaimer on the back of the box that reads "Includes a single use code granting the user access to the DLC" or something along the lines of that. EA did the same thing with Mass Effect 2.

This lawsuit is simply a moron(s) who are upset that they are in fact, stupid and don't take the time to look into things like this, so they feel they should be rewarded because of their stupidity. No ones to take responsibility any more. It's always someone else's fault and its getting effing ridiculous.

lol...they tried to do that with me for LittleBigPlanet. I dont care if its never been played. If its open, then it should be considered used

In this case, absolutely agree man. It's like he got jipped...by his own fault, ultimately, and he went to the extreme of a lawsuit.

Any gamer that cares about stuff like DLC, does the research. Why? Because they've gotten burned, like he did, and learned they're lesson. And before any purchase, they google the **** out the game and cover they're asses.

He should have considered it a $10 lesson in DLC research. Not such a bad price for knowledge, but sigh...the lawsuit is ****ing stupid. I doubt it'll get to court, and not get tossed.
 
I don't know why so many people care about a game being opened... it's never been used, its sitting in a little plastic sleeve in a draw.... Loads of places do this... When I worked at Blockbuster, we did this with all the Retail stock. Also, EB Games, JB Hifi, Myers, hell, every entertainment place I can think of does this, for the simple reason that a) it's cheaper than getting those massive f**k off plastic theft proof cases for every game, and b) you can fit more discs in a draw than you can fit full games cases, which is very important if there isn't much space in the store (which is usually the case).

I'm not defending gamestop (or EB for me), they can go bankrupt for all I care. I just think it's pretty precious to be nickel and diming it over an opened case that has NEVER been used.

Here's a rundown of why gamestop sucks dick.

Their company policies and stances are absolutely ridiculous. Did you know that they're not actually supposed to tell you how much in store credit you're getting from games until you actually agree to give them the games over? Not every follows this policy, but it still stands.

They'll buy used games from you and sell them with a 500% markup of what they bought them for. I sold them a few games years back for something like a total of 30 dollars for 8 games, and the next week I saw each one of those 8 games for 19.99+.

Their warrenty/preorder system is a joke. Preorders don't mean **** other than "I already partially paid for the game". Think it means you'll be guarenteed a copy? Think again. If you' get there before they sell out, then yah good for you, but if it's a game that's going to sell out and you pre-order without getting there before they do sellout, you're going to be **** out of luck. The Warranty system is even more of a joke. They have their own special warranties for RROD's and what not with the 360, but it ends up costing an extraordinary amount compared to dealing with Microsoft themselves.

Managers and employees will lie, cheat, and steal from you, right in front of your face. I actually had someone tell me "No, Demons Souls never got ported to America, if you want it you'll have to get the Weeaboo version, you should pick up blahblahblah instead"

The employees there are an absolute joke. Maybe not 100% of them, but a good 90% of them will scoff at any purchase you make that they don't find cool. Wanna buy a game for your nephew ? Get mocked with things like "why is someone as old as you playing these games"? or "want anything else, something more mature like MW2 or MAG?" so on and so forth - as if my reasoning for buying whatever game or accessory I'm buying is any of their business.

The "new games" are an absolute joke too. What's that? If you're not one of the people that gets the first wave of shipments in you're going to have to grab one of the display cases that's already opened, and we're going to give you a game from an envelope under our drawer where countless neckbeards have gotten their smuggy ass fingerprints all over the bottom. Oh, and did I forget to mention the whole "if you're a gamestop employee you can 'rent' out any new games" - preorders be damned. I went to pick up a copy of Knights in a Nightmare, and when the dude grabbed the game he went "oh hey I remember this game, yeah I was playing this one earlier, its not very good". Got home and there was already a save file that was halfway completed. This was supposed to be a new copy.

So yes, Gamestop is a piece of ****. 90% of it's employees are pieces of ****. It's corporate model is a piece of ****. It's policies are pieces of ****. If a company like Sony or hell Planters Peanuts tried to pull the same kind of ******** gamestop pulls they'd be shut down pretty swiftly. But, it's just video games right, so who cares? :rolleyes:

I get all my **** at Target/BestBuy now. Which, is much better to be honest. No snarky ass comments from clerks, cheaper prices, and the games are actually sealed when you buy them, new. Who woulda thunk ?

you're not getting the principle. If its open then it should be sold at the opened price. It shouldnt be sold as new. There is nothing wrong with selling a display copy. If they were to sell it at the used price, it woudlnt be an issue. A Gamestop employee tried to do that to me once and I wouldnt take it bc I was buying the game as a gift for someone and its not right to give gifts to open already opened. So you know what he did? He didnt sell the display to me; he instead took one of the new preorders which were on reserves and gave that to me. It was good for me but sucked for the guy that pre-paid and was coming in later to pick up his copy, only to find that it wasnt in the store and wouldnt be until they got their next shipment

Cool to hate gamestop? You honestly think I give a **** what peers think of me to a point where I'd take a stance on something blindly like this? I've been ****ed in the ass by Gamestop plenty of times to know how ****ed they really are. I have some very, very close friends who work at different gamestops. One's a manager, one's a newly hired clerk. They BOTH have these 'horror stories' of how awful the place really is.

Hell, my manager buddy flat out told me that the company is ok with robbing people blind and taking their games. He had a young kid (as in younger than 10) trade in 5 games for a total of 11 dollars credit or something, and couldn't say "no we cannot accept these games from you" to try and help the kid out because it's against store policy. So this kid trades in his games, gets his 11 dollars store credit, realizes he can't get anything with it, cries to his dad, his dad gets into it with my buddy (the manager), who calls up someone from corporate, who then tells the father "perhaps you should watch what your child does more closely".

What the **** kind of soulless company is that?

The price, is the problem for me ultimately. I don't trust them, I don't know the dude who's selling me the game. He's not my friend, so if I'm not going on faith that the game hasn't been played.

I just prefer not to buy from them when I can avoid it, and leave it that. I avoid giving them my business. That's pretty much all I can do, really.
