You should consider making future renters pay a deposit upfront, if you aren't doing that already. It'll help lessen the sting when some jerkstore runs off like that.

I know a guy who rents out several houses, if I can get ahold of him tomorrow I'll quiz him on how he handles stuff like this, though it might not matter depending on how different laws n such are.

I know nothing about small claims court, just be careful you don't get stuck paying out even more in legal fees or whatever. I too suggest seeking a lawyers opinion.

Yeah, I collect $200 deposits and it did help. The next time I run a house I will make deposits a lot higher and refundable (hopefully) -- anything to never go through this **** again. It's ridiculous. I'm starting to see why landlords make people pay first and last month's rent up front too. I think it's just too much to charge people, but then they go and pull **** like this and I see why it's done that way.

Here's what I'm thinking about the myspace. He apparently updates it and uses it; I want to see if the city changes from Bullhead City, AZ to Payson, Az. If so, this apartment clipping may truly be where he's staying..
Also, everyone, small claims court are cases involving less than $5000 and the persons represent themselves. You don't need a lawyer. You basically ask state justice to play the arbiter in a dispute. Amounts as low as $50 are seen and ruled on every day, along with amounts in my range and higher.

The most optimal outcome is I re-rent the apartment and collect my dues from it's former tenant. I have nothing to lose pursuing the optimal outcome, and plus, I don't know... ...I just get so sick of people stepping on me, because I'm so trusting. I'd walk right into a rake, if you assured me it won't whap me in the face.

I don't have a bone of mistrust in my body, and it's the roller-coaster of my life. I must adopt more pragmatic dealings with people. I don't want to be that way, but there's a difference between being "a meanie head" or whatever I childishly fear becoming, and just plain wising up.

I lost $11,000 dollars when my apartment was broken into and my entire home theater system was stolen and your whining about a measly $450? I don't feel bad for you.

I was suggesting combing your local telephone book for some sort of advocacy group, maybe for women or landlord/tenant and such matters.
I find it to be a great resource, it's how I figured out about filing bankruptcy to prevent foreclosure.

Start by talking to a lawyer.
Ok gals, I did go ahead and call my legal insurance and it looks like I don't have to worry about the driver's license. He will probably have all his mail forwarded to himself, so what I should do is kinda weird: send a "disposition of debt" to my own house (but addressed to him), and it will automatically forward to him. If he does not pay it or respond, I can also send the court order the same way.

After I get this disposition done, they will instruct me further. It's too bad he didn't just pay the $450. Now I'm going to charge him for changing the locks on my door, and all cleaning fees associated with making his room presentable for the next tenant.

Tzarinna thank you for that tip. I don't want to be in this situation again, and I'll definitely look into advocacy groups that can help me run this household more pragmatically. Thanks!

My lawyers sent him my notice but he hasn't set up a forwarding address yet. I emailed him on myspace, telling him his last check and a notice from the IRS is in my possession. If he'll set up his mail-forwarding, I'll gladly drop his mail in a box... ...along with my lawsuit, but he doesn't have to know all THAT...
