Tobey defenitley does need to return, I've loved his portrayal as Spidey and I think that portrayal should continue.

That's exactly why I think that if they are just going to recast Peter Parker/Spider-Man, they mine as well start a new franchise of movies. It couldn't hurt to wait a few years & then begin a totally new franchise using different villains. That actually sounds better than making a Spider-Man 4.
