Apparently it comes before TIH, as Stark seemed like a part of Shield by then "We're putting a team together..." "Who's we?" "-smirk-"

Where as in SHH's review of the footage that went up today at comic-con, Stark was telling Fury "I'm not interested in your superhero boy-band" so... there you go, it takes place before.
