When I let one of my friends fall from a third story, that's what I'll tell the cops too. "I wasn't trying to kill him, I was just trying to scare him! What's the big deal? I just crippled the guy."

Honestly, I really don't care that Burton's Batman killed. It's not like Bats has never killed in the comics before. I just found the comment funny that you said he was only trying to scare the guy, because lighting them on fire is a bit intense, since (depending on how panicked the person is) people still die and forget to do the basic "stop drop and roll" thing.

Really though, either way, I don't mind that Bats did it.

On a side note, while watching Returns, it made me wonder why in the heck Burton didn't have the circus goons for Joker. It seems like it would have fit much better.
