Can someone please settle this for me once and for all.

Let's say the Senate doesn't convene until after Inauguration Day. Trump's term is over. Can they still vote to disqualify him? I thought they could only do that if they vote to remove him first, which they obviously cannot do if he's already out of office.

I'm getting very confused by this.
It is not a settled point of law. The answer is not expressly stated in the Constitution and there are no judicial decisions adjudicating the issue. It is a novel point of law.

I'd also like an answer on this bc I believe someone basically said that if the Senate vote is punted until after inauguration, it will be put forth in a Democrat-controlled chamber now that Warnock and Ossoff are there, and it passing as well as him being barred from ever holding public office again is more likely. Is this true?

Don't they still need 67 votes in order to convict him and bar him from ever holding public office?

Yes. It's just the Impeachment not the conviction/ removal today.

Convict - 2/3
Barr from office after conviction - majority

That's all predicated on the senate being able to convict him after the inauguration.

That's just insane.... :(

It isn't comforting, that's for sure.

If Pence were to be the 2024 candidate, he'd have an uphill battle since the Trump die hards hate him.

It's still mind-boggling that these insurrectionists wanted to kill Pence for sticking to the constitution.

And it makes Trump look even worse, if that's even possible at this point. He wanted to kill his OWN Vice President for trying to do something that he had no control over. And now he's lost his only advantage because Pence isn't going to pardon him if he steps down before 1/20.

Pence's post-VP career isn't looking bright. He might be able to get a cushy K-Street gig but will he get the Republican nod for the 2024 Presidency? Nope.

We need to start considering racism or hate speech a violation of a congressman's oath. A representative must represent all the people in their district or state . They cant do that, and be ok with racism.
