It is not a settled point of law. The answer is not expressly stated in the Constitution and there are no judicial decisions adjudicating the issue. It is a novel point of law.Can someone please settle this for me once and for all.
Let's say the Senate doesn't convene until after Inauguration Day. Trump's term is over. Can they still vote to disqualify him? I thought they could only do that if they vote to remove him first, which they obviously cannot do if he's already out of office.
I'm getting very confused by this.
