Once Maroni goes (presuming he usurps the Falcone empire), The Penguin and Rupert Thorne should fight for the mob control of Gotham. All this while the Joker has his own agender and Two Face is going crazy.

It's like the Joker without his grin (not neccessary a perminent one). You can have someone look like that and still be "realistic" just not to such extremes as Tim burtons had.
And especially no black goo coming from his mouth, no long hair that need to be comb and you certainly have to do away with the Flipper hands.
Get back to what the Penguin was in the books, a cunning aristcrat that secretly turned to crime but still runs in the same high class society circles as Bruce Wayne does.
