True that. But whether that was Tom Jane or not, what are the chances of seeing a guy that LOOKS like Tom Jane in all black who's based on a character that first appeared in a Spider-man comic? They did it intentionally.

Fox doesn't need to have the rights to the character to have "someone" frozen in a glacier. There's no evidence to say it's Cap. America. No costume, no shield, not even a red/white/blue coloring, so Fox easily could have a person in the glacier and let the fanboys get excited about it.
That said, I don't think it's Cap. I don't even think it's an intended human form. It has some humanoid shape to it, sure. But I think that's by accident and it's a case of people seeing what they want to see. Here's the example using the picture in question.

In the first image, you have shape everyone's talking about. in the second, you could picture it being almost an entire human body, the head hidden in shadow. And in the third, you could imagine it being the legs of someone.
