Rocket Raccoon has been around since the 1970's and precedes Star Fox. So if anything, Fox is a ripoff of Rocket Raccoon.

Marvel has a good track record of pulling the improbable off, but the raccoon seems like a potential disaster. Marvel doesn't have to use it since there are so many potential members to have on the team. Most of the others don't have the same drawbacks, except for the space-dog. I would sooner see the Pet Avengers as a cartoon than that raccoon on the big screen.
