With regards to costume some may consider what he is wearing a costume though in his mind it would be his normal wear. This guy is not from Earth and he is very powerful. Big clue.

And technically, The In-Betweener is not a villain. He is a fighter who is used by the cosmic forces like Living Tribunal. There is no good or evil, hero or villain factor in the cosmic balance. Just like you can't say Chaos is good and Order is bad. Or that Galactus is a true villain. And he's also sexless.

Your points are valid. He is a cosmic entity. But he has been portrayed as a male and not female. Further he was a villain in Silver Surfer 15 when he manipulated Sue Richards.
