The origin needs to be in the film, if I had the power to remove it, I wouldn't do it.
As we are now stuck with Spider-Man first allowing the man he thought was Uncle Ben's killer fall to his death (and did nothing to save him), sure, kick his ass but don't let him fall to his death, when you're now involved with his capture. The idea was to stop him, do the right thing, and hand him off to the police. Don't forget Sandman being Uncle Ben's killer. Spider-Man letting the killer go free, mocking the "With Great Power..." motif in which Spidey stands for. Just say sorry and Spider-Man will let you go free for murder. Accident or not, your ass belong in prison if your intent was to help carjack someone with a gun. His origin and character was butchered within his origin.
I don't mind when the movies deviates from the comic books either, I do mind, when it completely undermines and erases what the core of the title character stands for. That's why the origin story needs to be retold.
