20th Century Fox Suing Over Warner Bros. Watchmen

We're at least 3 hours away. Plus, there won't necessarily be an immediate announcement. We might not know anything before tomorrow morning.

And it's VERY doubtful that we'll know any of the details. They'll leak eventually, but don't bet on getting any more news than "they've settled for undisclosed terms" right away.

Agreed ET. By the time the two parties put together a joint press release, we may be looking at Friday or possibly the weekend before an official statement is announced.

fox paid warners 400 million to purchase complete control and rights of the film. the film release has been pushed back to summer to give fox time to "fully realize" their vision of the film.

Settlement reached?

Geeks can now rejoice.

Warner Bros. and Fox have resolved their dispute over "Watchmen," with the studios scheduled to present the settlement to Judge Gary Feess on Friday morning and request that the case be dismissed.

Terms of the agreement will not be disclosed, but it is said to involve a sizable cash payment to Fox and a percentage of the film's boxoffice. Fox will not be a co-distributor on the film, nor will it own a piece of the "Watchmen" property going forward. The studios are set to release a joint statement announcing the agreement Friday.

A Warners spokesperson would not comment on the settlement. A Fox spokesman said no final deal had been reached.

Fox sued Warners in February, claiming copyright infringement based on agreements the studio had with producer Larry Gordon. Feess ruled on Dec. 24 that Gordon did not secure the proper rights to "Watchmen" from Fox before shopping the project and eventually setting it up with Warners. Feess' decision prompted settlement talks to heat up because Warners faced the prospect of an injunction stopping its March 6 release of the $130 million comic book adaptation.

While Gordon is not a party to the case, Warners is said to be pursuing the producer and his attorneys to reimburse it for the costs of the settlement. During the course of the litigation, Gordon's then-attorney admitted that he negotiated Gordon's 1994 separation from Fox without knowing about a pre-existing 1991 agreement on which Fox has based its lawsuit.

The rare showdown between studios became particularly nasty in recent weeks, with Gordon and the film's other producer, Lloyd Levin, lashing out at Fox for making a claim on the film. Fox repeatedly has stated that it asserted its "Watchmen" rights before Warners began production on the film and that it sued only when its assertions were ignored.

With the settlement giving Fox a piece of "Watchmen's" revenue, the studio now has a rooting interest in the film's success.

I hate to be the one who is possibly in negative Nancy mode, seeing how there is closure to the settlement, why would the Fox spokesman denie that no final verdict has reached between Warner Brothers and Fox if he knows? I can understand if he knows, but want's to lie or has to lie,but if it isn't the latter, then what is up with that?

Yeah, just read this at HR's site. I guess everyone can calm down now. It looks like the film will make it's original release date.

A couple of interesting things though. The report implies that FOX tried to contact WB early on but was ignored. The other thing, "good guy" WB is now going to hang Gordon out to dry by sueing him and his attorneys.

Watchmen Lawsuit Finally Over!

Fox and Warner Bros. come to a settlement agreement over movie rights dispute

It's official: The lawsuit between Warner Bros. and Fox over the movie rights to Watchmen has been settled! That's right, all of us fans will be seeing Watchmen hit theaters on March 6, 2009 as planned!
Fans have been praying this would be coming today after a Notice of Settlement form was filed yesterday.

Today, Fox and Warner Bros. resolved their issues over the rights snafu which has been blamed both on cagey Fox lawyers and Watchmen producer Larry Gordon.

Lawyers from both sides told Judge Feess that a settlement had been agreed upon in chambers during their 3:30pm court appointment.
A hearing has been set up for Friday, January 16 to present the settlement and have the case dismissed. Details of the settlement have not been released, but it is said to includes a huge payout to Fox plus a tasty percentage of the film's box office earnings.

As it turns out, Fox will not be distributing the film and will also not own any piece of the Watchmen property moving forward. I guess that means no cut on merchandise, or the planned simultaneous DVD releases.

Both studios are said to be drafting a release to announce the settlement details which will likely be made public within the next 24 hours.
We will, of course, update you on the story as soon as more information is made available. In the meantime, feel free to celebrate — Watchmen is coming on March 6th!

BOOM SHACKA LAKA!
