Yeah, you can call it confirmed. It looked black in every single photo (most notably the batfleck headshot one) and also on SDCC exhibit.

I don't recall Smith explicitly saying that it was black though, just that it's the same suit from TDKR.
But who gives a damn what Smith says, anyway. t:

That scene was epic but the movie was a big let down. Worse than Reloaded and I didn't think it could get worse.
