My nephew physically assaulted me.

So if I go in someones house and kick the ass of one of the residents, the homeowner is the only one who can lay charges?

According to the cop, yes.

A tampon store?

..sorry I couldn't resist that one. :o
Dammit! The man's name is WAR LORD! He'll open a battle axe store.

Other than the fact that Canadian law is bizzare... the person assaulted doesn't have the right to press charges, and can be over-ridden by the homeowner? What if the homeowner was the one doing the assaulting... for example, a man beats his wife and he's the homeowner (her name isn't not the deed or mortgage)? It's an assault against a person not the home.

Anyway... aside from the bewildering nature of Canadian law... I really am speechless.

That's the wonderness of Liberalism, making a bad situation worse with good intentions.

I don't know I think I'd make up that law too if you told me that a porty lil 21 year old slapped you around. It would save on paperwork or maybe he was off the next day.

So if you hit him mommy calls the cops but he hits you and she doesn't? Must suck to know that no one, not even your own mother, likes you.

Ain't life nice?

She's getting up in age and I get to pick the nursing home for her.

Well, according to Jonty, his mom would've had to lay charges on him even if his nephew did call the cops. His mom wouldn't lay charges on her own son for a fist fight, so his whole argument of not wanting to risk a criminal record is thrown out the window.

My mother would have laid charges on me, not my nephew.

So what you're saying is that if you'd hit back, your mom would have pressed charges against you, but not your nephew?

Yes.

You might have a few posts, if you didn't get banned so much.

yeah, the cop was humoring him

How does that help your manhood? LoL " Hey I can get my ass kick so I can post about it 24/7 and increase my post count and eliminate any doubts of me having no life and self esteem" LOL!

Jonty Lost!

I have no need for my manhood. It would shrivel up and turn black and I wouldn't know the difference.

I did. Doesn't the victim have to consent to filing the charge in order for it to be done? If you'd told him you were pressing charges against him as well unless he would agree to not press any on you, then wouldn't both of you not be charged? I think just about anyone would choose neither person getting charged over letting themselves be charged.

He can risk a criminal record, because he's only 21. I can't because I'm older and the consequences of getting one is much more when you're older.

2. It was the principle of the thing. Doesn't matter if a person does major damage or if his punches are useless, nobody should tolerate being attacked.

tell that your buddy w.

What kind of store are you going to open?

A Petro-Canada, which is a major gas chain in Canada. Since I've been working with the company for at least a year, I get to buy into one at a deep discount of what they normally require.

Who needs the cops to kick someone out of their room?

I didn't call the cops to get him out of my room, but to lay charges.

I'm not kidding you on that one. In Canada, it's illegal to defend yourself beyond a very minimal point.

I know the law in this regard and that is the law. It's been a point of discussion and contention on talk radio up here.

I still don't understand what you were thinking. First you tell us that he didn't hurt you, then you want to lay abuse charges on him. If you weren't ABUSED how can you charge him with ABUSE?

They're talking about me kicking his ass. There would be no charges from pushing him out of my room, but hitting him there would be.

So why didn't you push him out of the room, rather than taking his "abuse"?
