So I just got assaulted

He heard yelling and cursing and me saying "AH!" as he hit me for a third time in the shoulder. I told him to call the cops.

He got angry. He started cursing some more, asking if I just called the cops. I told him "The cops don't randomly call people! I'd have to call them!" but logic was not his friend. He gave me the bat and told me to hit him in the head. I did not, because I know the law is I have to try to run away before it can be self-defense, and I didn't run away because I wanted him to be arrested. I called the cops. He couldn't decide if he wanted to attack me or run away. He fell down a few times running. Eventually he did run away, going into his house which was very close by. Then, a cop came, and not just any cop, but this cop is one of my friend's dad. So we went to a bar, cause it was nearby, and turns out he was kicked out of the place. Then, we went to his house where two other police vehicles already were. He was taken away.

I then drove myself to the police station, and my friend got there the same time I did. He thought I was right behind him and said he was very sorry. I laughed it off, I really was/am fine with it. We gave our stories to the police, had pictures of my bodily damage and car damage taken, etc.

The guy threatened and attacked an officer, too. He threatened their families. He's in big trouble.

Wow, people here have the craziest stories! Why didn't you just follow your friend in the first place though? I would've left as soon as I saw the guy.
 
yeah...the more responses I read in this thread...the more I start to doubt the details.

I fail to see how you were actually "assaulted". And your friend is a little *****.

There were several points where he just raised the pole, and didn't hit me but made me believe he was. That=assault.

He also actually hit me 3 times, and that=battery.

The reason my friend made it and I didn't was because he was much closer to his car.

Oh, and something weird happened today. I was talking about it at work cause someone asked what happened to my arm, and another coworker walked by when I said "He got arrested". He asked who got arrested, and I said his name. To which my coworker responded "That's my little brother".

That's not assault. Assault and battery are the same thing. The entire process will be referred to in court as assault & battery, and possibly assault with a deady weapon.

And possibly, as Ron White would call it, "being drunk in puBLIC."

Okay well I found the definition of assault differently somewhere else.

It was a physical or verbal attack on another.

Which is about the same as battery.
 
Yes, but an attack doesn't have to be successful.
 
Updating a dead thread: He's suing the police dept. now because of an alleged beating he got in jail. Now it's all over the local news. Yay.

I'm not going to be sarcastic to a judge (I haven't even gone to court yet). To the rest of you, I will answer questions this way because I think it is obvious that you can't just force someone to stop hitting you.

I didn't notice him until he was relatively close. I figured he'd keep walking by until he started talking to me

Where you obviously don't live because then you would've known to ignore the drunk guy hitting cars with a pole when he tried to start a conversation. I'm sure I've managed to avoid many conflicts like you've described by using this same method.
 
When someone asks you if you're a god, you say YES! Also, if someone looks straight trashed and is hitting **** with a wooden pole, you RUN! Faster if the pole has a nail in it.

You CAN force someone to stop hitting you. I assume you're young or kind of small, or both. I can understand if that would make you reluctant to try and physically restrain someone bigger than you. I don't understand that it was at least two of you, you out numbered him. He can't hit both of you with a pole at the same time. Your friend should have stayed with you and help defend you. Then again, he may be young and small too. Now he's sueing the cops. Sounds like a great guy. Maybe it was better if you didn't try and fight him, he sound like a psycho.
