and to be fair they are both physicists so the confusion is understandable, and they have both shuffled off this mortal coil.

Possible spoilers

My guess is that Batman struggles with the choice of killing the joker, and that he ultimately decides to spare him and he goes to court. During the trial Joker scars Harvey Dent, causing Harvey to think "If Batman had killed the Joker this wouldn't have happened" thus warping his concept of right and wrong.
With this new sense of justice Dent hunts down Maroni and the reported limo scene takes place.

Jes. It's too obvious that it's Maroni and not Joker because that's just how Two-Face's origin/story has always been. As well as for the reason you pointed out.

no he didn't. At least no where that's documented by a reliable news source. however a few years back Goyer indicated that it was his plan to have Joker do the scarring. So do with that what you will.

Yeah and he said it was suppose to happen in the third film. Roberts said in FHM that he was indeed throwing acid on Harvey Dent's face. He said that they stayed close to the comic book.

Of course. My comment was indicating that Eric Roberts has not been quoted in a reliable news source as saying that IN THE MOVIE Maroni scars Dent.... Also great as they are, the comics do not qualify as a reliable new source.

no no no no no! Why do people always ask for an explanation for things, we're not supposed to know who joker is! No origin, no stupid name nothing, its supposed to be mysterious and creepy thats the whole point!

They stay pretty pretty close and Harvey Dent wants retribution. Anything else?
 
The reason its not Maroni that does the throwing is: There is no way a person throws acid in another persons' face in a court of law, and is then in a limo a short time later.

Come on guys think this one through. Maybe Maroni puts the joker up to it

You are right, actually. An henchman do it for Maroni but Sal is present at the scene and he is the one responsible for Dent's scaring. Now if you want to believe that the Joker did it. Fine. Tired of arguing with you.

Maroni throws acid on Dents face in the Comics.
He says they stay pretty close to the comics(Why would he simply say "YES, yes I do! Wanna know how I die, as well?".

Even if in the movie Maroni himself doesn't throw the acid, the acid throwing definitely has something to do with him. Maroni has every reason to throw the acid/have someone throw it.
Joker? What reasons would he have to even BE in the courtroom?

Nolan may tweak a few things here in there for realism, but I see no reason why he would choose to just toss away the Two-Face story and have Joker do the scarring. Nolan's not Rami.
 
I've not seen the movie or read a script so it goes without saying that I'm just making educated guesses here. That being said.

I submitted a very plausible reason for Joker to be in a court room: that for Batman it may seem a victory that he didn't give in and kill the Joker when he could have. But when Dent is scarred it makes him question himself even more.

And according to The Long Halloween Maroni isn't in the court room, but is blowing out his birthday candles at the time Harvey is scarred.

And no one's arguing.
