My guess is that Batman struggles with the choice of killing the joker, and that he ultimately decides to spare him and he goes to court. During the trial Joker scars Harvey Dent, causing Harvey to think "If Batman had killed the Joker this wouldn't have happened" thus warping his concept of right and wrong.
With this new sense of justice Dent hunts down Maroni and the reported limo scene takes place.

Yeah and he said it was suppose to happen in the third film. Roberts said in FHM that he was indeed throwing acid on Harvey Dent's face. He said that they stayed close to the comic book.

The reason its not Maroni that does the throwing is that there is no way a person throws acid in a persons face in a court of law and is then in a limo a short time later. Come on guys think this one through. Maybe Maroni puts the joker up to it
