That's kind of the overarching point of The Penguin, in terms of who he is VS what he does. He's someone who should never have been able to attain the type of stature that he does. He wants nothing more than to attain that stature, and finds himself hitting a wall, so he turns to other means, like a lot of real criminals. He's Strain Theory in action, and he's also an incredibly driven character.

I really like the use of Penguin. You've got Bruce Wayne, a rich powerful figure in Gotham who's alter ego Batman is a wanted fugitive. Meanwhile you've got Cobblepot, a rich influential political figure in Gotham who has taken a lead role in being vocal about the capture of this fugitive Batman. His alter ego known as "the Penguin" is secretly smuggling and supplying Gotham's criminal organizations with weapons behind the scenes. Helping to turn Gotham against Batman while being a true criminal himself. He doesn't have to be the main villain but a supporting villain in that capacity.
I like this idea. It puts Penguin as a sort of puppet master. Penguin was always more of a cerebral threat than like likes of most of Bat's rougues gallery. He was able to try to run for mayor in the comics if I could remember correctly (although it seemed REALLY farfetched in Batman Returns...especially the fact that it seemed like he was winning legitly in a way, I mean it was like... "Really Gotham?") Oswald could be playing both sides of the law. The best way to run the show is to let someone else think they are running the show (in this case it would be Black Mask). Plus, if they still go with this freak uprising thing, when Batman confronts Penguin, he would be more calm and collected and possibly offer a way to stop this freak escalation by making Gotham the way it was... corrupt and under mob rule, which would pretty much undo everything Batman has done with the past 2 films. Of course Bat's wouldn't take this, but it would bring up the whole "which is worst scenario.
