given that Goyer said it was a mistake to kill off the villains, especially The Joker...well, you can figure it out.At the end of most films like this the bad guy always dies in the end. So,should the Joker meet the same fate in TDK?

I say that he "dies" like he did at the beginning of Batman's run, you know, He dies but a body is never recovered.
That's not exactly how it happened in #1, but now that you mention it, what does happen in that issue would be hella cool on screen. I mean, think about it: it's near the end of the movie, and the police or whoever have Joker's body in the back of an emergency van. They're driving down some street when one of the doctor's notices that "this guy's still breathing!" We see one of the Joker's hands raise up behind the turned doctor's head as someone else goes "what?" And the Joker leaps up to strangle the guy.
The last shot is the emergency van driving off normally. Fade to black.
