2) The free roam. It appears that my biggest fear came true. There is one problem I have with all superhero video games with free roam of the entire city: it looks very unrealistic to have only about 10 people and 10 cars on every street. The Spider-Man games are extremely guilty of this, where there are only about 15 people in the entire Times Square area. This wasn't an issue for Arkham Asylum and Arkham City because those games respectively took place in an asylum and in only a part of the city that has been closed off from the rest of the world & has been turned into a prison.
In the demo of this game though, it appears as if there are barely any cars and barely any normal civilians in New Gotham, which is to Gotham City what Manhattan is to New York. Even with the Christmas setting and the bad weather, it is still very unrealistic. During the scene in the demo where the Joker blew up the next-door building and Batman asks how many people he killed, my first thought was "Well, he probably barely killed anyone since the whole city looks almost deserted."
I will reserve judgment till the game comes out though.
