It may not be a fully new idea but it happens all the time in the comics since the originals. He's an industrialist and one of his main problems is watching out for industrial espionage.

I thought Tony specifically refused to copyright or patent his stuff since he'd have to provide the government with blueprints and such to have it on file and he doesn't trust them to keep the schematics safe or even refrain from stealing the ideas themselves. So he keeps all the linch-pin stuff in his head where nobody else can get at it. Like the secret of what makes the mini-arc reactor work. Without that, all the rest is useless.

I agree the Armor Wars saga that ended the run of the silver and red gear was 100% based on Hammer and others stealing or selling his tech.

Justin Hammer infiltrated Natasha Romanov on Stark Industries to distract Tony while he robs and sells Iron Man's tech in Black Market, including the Chest Piece that eventually comes to the hands of Whiplash, I tell you!
