A joint deal makes the most sense for both studios. Sony gets less risk and more potential gain. Marvel gets to use Spidey in their MCU. Spider-Man movies co-produced can be inserted in the existing Phase II schedule without postponing or delay the current slate. Make a deal like this:

SPIDER-MAN SOLO MOVIES
Marvel Studios have creative control with assurances made to Sony (like they won't kill off the character)
Sony & Marvel co-produce the films (percentages TBD)
Disney markets
Sony distributes and keeps distribution fee
Sony & Marvel share in the profits (percentages TBD)
Sony maintains BluRay/DVD/Digital rights
Marvel maintains merchandizing rights

OTHER MARVEL FILMS WITH SPIDER-MAN APPEARING

If Marvel makes an awesome Spider-Man film, then great.
If Marvel makes an/a okay/decent/meh Spider-Man film, then the character is not meant for the big screen for a while, lol.

Even if the first Spider-Man MCU film isn't great, Spidey will still get to appear in the crossover event movies. Reminding me once again of the Hulk a bit. But I doubt they would do anything that bad.

Sony doesn't have the balls to pull off a Sinister Six movie, not now.

Spidey NEEDS to be great in his first ever solo MCU film. He can't be a character that only really works well when he's with another Marvel character doing crossovers.

Thor and Captain America were 'satisfactory' origin movies for the characters which led in nicely into "The Avengers", the films themselves weren't that special. Get the origin story out of the way and you can do something really impressive in the sequel, i.e., what they did with "The Winter Soldier" (and really not so much with "The Dark World".

Spidey won't need another origin story or need some kind of film where they're establishing his role in the MCU, amongst other heroes; they can just throw Spidey straight into there with no continuity whatsoever and tell whatever story they want. All they might have to do is throw in a very small reference to another MCU character, maybe Tony Stark (maybe Peter is interested in his technology?), and there you go, the general audience can quickly acknowledge his present in the universe and won't scratch their heads if they ever suddenly see Spidey in an Avengers film.

Well yeah, I get what you're saying. I was only speaking hypothetically, "IF" it wasn't great. I think whatever Spider-Man film we get is going to be very good. Heck, get Joss Whedon on the job. He's done with Avengers 2 and I think he would be PERFECT for a Spider-Man movie.
 
Joss won't take on Spider-Man... Although that would be SUCH an awesome movie. If there's anyone that could nail Spidey's humor it's Joss. However, I just don't think he would be up for it. It's like the coach of a team moving down to offensive coordinator, in the grand scheme of things.

I don't see Spectacular Spider-man here. I want season 3 dammit! :argh:

It probably won't happen but that's just a fantasy of mine. Heck, I'd love for Sam Raimi to return. Disney would probably let the guy make a movie he wants and give him more creative freedom.

All of the rest of the movies are masterpieces and they make HELLA tons of money. And Avi is fired and goes broke and ends up living as a hobo on the streets.

Hey, if they managed to pull that off then I would applaud Sony. But really... it's probably not going to happen. If TASM3 does happen then I don't see it being a very good film.

1. Make more Spider-Man movies at a diminishing rate of return for the immediate future. Given that TASM2 barely made into the black, this almost certainly means losing money on at least the next couple of films, and praying that the films improve and audience eventually comes back.

2. Don't make more movies and let the rights revert for nothing. It stops the bleeding immediately, but they don't get anything out of a valuable asset either.

3. A deal.

Option 3 is the least bad of those.

Sony is like a small market sports team with a big star about to become a free agent at the end of the season. They can't afford to keep him. Letting him walk for nothing isn't a good option. The right move is to trade him to a contender and get something in return. Sports fans will know what I'm talking about. It happens every year.

Well said. Sony has to think about the long term: making a deal with Marvel means that they co-own the property for many years to come. Not making a deal means that they will more than likely lose the property for good sooner or later.

The thing is, after TASM2, even if TASM3 is great the box office is almost certainly going to go down. And where the franchise currently stands, the box office going down means profits going into the red.

And that's TASM3. The potential for the spin-offs is far worse than that.
