Whether or not FOX's X-Universe has toys and other tie-in merchandise is not that studio's decision. Marvel may have given away the farm with the company's bankruptcy era movie deals, but per the pre Disney merger 10ks, they kept control of the merchandise. The lack of X-Men tie-in merchandise has more to do Disney/Marvel not wanting to set aside retail shelf space for characters they don't fully control than a change in tone for the X-Men series.

Bottom line is: Fox and Sony are still have to greenlight the creation of merchandise across all platforms for their Marvel properties. Fox has specifically avoided doing kid-friendly merchandise (i.e. toys, lunch boxes, etc) for First Class and The Wolverine because they are not kid-friendly films. That's also why Marvel just launched their own independent Wolverine toy lineup.
Just look at all the Amazing Spider-Man toys on shelves right next to the Marvel Universe Spider-Man ones. That alone disproves your opinion.

Here's a direct quote from the 2008 Annual Report for Marvel Entertainment, Inc. You can find it online at sec.gov under Part 1, Licensing, Feature Films:
"Under these licenses, we retain control over merchandise rights and retain more than 50% of merchandise-based royalty revenue".

Marvel launched an independent Wolverine line so that they wouldn't have to pay FOX their share of profits from movie tie-in merchandise.
Interesting, just watched an I terrier with Hugh Jackman on Sky 1 and he said Chris Nolan told him that the first X-Men was part of the inspiration for his take on Batman. He liked the way it was done in the real world.

you know... it just occurred to me. Anyone have an answer to why wolvie has his memories back? He remembered World War II, and there's a sound bite of him screaming Kayla's name from XO, both took place after the "magic bullet"

It's the same as the flashback stuff in the earlier movies. I don't think he remembered Yashida when he first met Yukio, but he needed to leave town after the fight with the hunters (there was a police car speeding towards the bar when they were in the car), so he just went with her.
I think the memory actually came back to him when he was with Mariko and found the well.
At the end of X2, he began remembering more and more. Getting closer to the source (Japan) and actually meeting the man from the memory most likely brought it back in full.
You're not understanding the point I made. Sony =/= Fox.
Sony, Universal and Fox had approval authority for movie products based on Marvel characters from their films. Universal no longer owns Marvel characters so they are out of the mix. After the Disney merger, Sony willingly relinquished their merchandising rights in exchange for box office revenue. But, Fox didn't agree to the same deal. They still own a large portion of merchandising rights as well as approval.
That's why on all the Diamond Select, Gentle Giant, etc products for Wolverine they still have Fox logos. They simply do not want to go the all encompassing kid friendly merchandising route with these movies at this time.
That's something that neither Disney/Marvel nor Hasbro are happy about, because they want to see as many movie based toys out there as possible.
