And yes, Feige has spoken about that several times. It's obvious to everyone except Poni that the Skrulls --- like the Maximoffs, and probably plenty of other cases we haven't even touched on yet --- have a "conditional use" clause built in.
When talking to the interviewer about why they used the Chitauri Feige says that "that's why we chose that name" referring to the rights issue with the Skrulls. So I imagine that Marvel can use certain elements of the Skrulls like their shape-shifting ability and their basic societal structure and design but they can't actually refer to them as 'Skrulls'.Where in that interview did he say that? Marvel kinda missed the boat on the shapeshifting abilities altogether. The comic-book Chitauri (who were Ultimate Skrulls By Another Name) *did* have the shapeshifting ability, but Avengers obviously didn't use that. Doesn't mean the Chitauri can't shapeshift at all, or that they won't display the ability in future movies, but people will question then why they didn't do that in TA1. A "Secret Invasion" infiltration would've been far more effective than the "let's gate in en-masse and blow up Manhattan" strategy.

They can probably use them at the same time, Fox just can't alude to their Avengers connection and Marvel can't alude to their mutant connection...unless they reworked the contracts. They probably could't use the same actors either.You know what I'm wondering? If either Marvel or Fox decided to use Quicksilver, Scarlet With, or the Skrulls first, does that prohibit the other studio from ever using those characters? Or is it possible that we could see those characters being used simultaneously by both studios? If so would they have to use different actors? Could they possible connect each universe together?

The ships in the background of the GotG concept art (if they are ships, as Sam pointed out) are similar to this Nova ship from Marvel NOW Nova #1.
