I have no clue. I'm just going by what I was told. All I know is that they were just released and one of them has a tether. :confused:

Who told you that? Were you not subpoenaed to court to testify as the victim?

What is a tether? Is that what they call an electronic monitor up north?

Anyways, thats pretty weak if you ask me. A couple of months (tops) followed by probation (probably a probated sentence with the first portion to be served in custody).

Jason gave me the update. And yeah we went through the entire process months ago...I posted it here remember? I also think the judgement was on the weak side, but I'm also pretty sure that there's a lot that I'm not privy to. Since you're in the force, what do you think they should've gotten? Because Jason seems to believe that was a fair punishment.

I must have missed that update then, even though I have followed this thread almost daily and THOUGHT that I had read every post. In fact, that was something I was looking for so I could see what happened to them and all. If you have any idea of what page that might have been on, let me know.

As far as my opinion, I would have to know what their actual sentences were to make any kind of call on that. But I was basing it on what you said and it seemed to me that you felt like they were getting a deserved harsh sentence (in other words, you seemed satisfied with what you were told and all). I guess they were probably only charged with misdemeanor battery. If that is the case, then the sentence (as you told it) does seem appropriate. It just seems, from the way you described it, that it was pretty harsh....almost bordering on a hate crime in some ways. They definitely targeted you.

However, I do know that people who have come to Georgia from New York, Boston and other big cities are amazed at the sentences they receive for crimes here...so Im sure there is a "southern curve" affecting my opinion.

And I never feel like criminals get what they deserve because of what I know about the process and such. Wayyyyyyy too many get to plea their case down to some chicken **** lesser crime or even a misdemeanor just to save the court's time and money, when they are guilty of sooo much more. When I was a probation officer, I had a guy on my caseload for possession of cocaine. Pretty standard, he didnt require house visits or anything like some offenders. But when I read this guy's file, I was blown away. This was his 4th felony conviction and he had already done "life" for murder. Yes, you heard me right, "life" in Georgia is a minimum of 7 years....and guess how long he spent in prison? 7 years...not a day longer.

My thing is, if a guy picks up his 4th felony and has a murder conviction, there is NOT ONE reason to put him on ANY kind of probation, much less the lowest level possible, with no home visits, electronic monitoring, etc etc. NO REASON. This is one case of many that I have PERSONALLY dealt with and seen the BS that goes on due to failures on various levels-DA, Judge, on down the line.

Speaking of all this, I meant to ask you. I remember you saying that David is a DA (I will assume for the moment that you mean THE DA and not an assistant DA) and that he makes well north of 100k annually. Is that only from his job or what? Because a DA here makes NOWHERE near that, especially one without 20+ years of experience in that position. Just curious.

It's skewed too, not just with big offenses either. When I first started working night shfits I know I must've seen 200 drunk drivers walk without being charged or with charges being dropped because we ran out of room in the county jail. Some of those guys have 4 or 5 offenses.

But I agree there's no reason for someone with a murder conviction to get probation at all. Hell there's not a whole lot of reason for someone with a murder conviction to only serve 7 years.

Strange...I just checked for it myself. It's not here anymore. WTF? :confused: I know I edited a lot of stuff to keep things "clean" but I don't recall actually deleting any posts completely. I distinctly recall typing up a report about the whole visit to the precinct, the paperwork and identification process and the fact that both Jason and I testified. However, there are at least 3 threads merged here; I'm not sure what happened to it.

I personally felt they were targeting me for both gay AND racist pig reasons; they certainly said some things that alluded to that. But it wasn't something that could be proven in court. They had a very effective lawyer--and I don't believe she wasn't court-appointed. As it was, there was two of them telling one story versus mine. And they flipped it like I was instigating/leading things on towards a conflict. However Jason brought credibility to my story with his report--although he wasn't present to witness events at the time the fight actually started. The judgement seemed fair at the time I guess, but time flew by so quickly and they're already back out on the streets, although not here.

Perhaps. Obviously, the jails here are full to capacity. During the process I distinctly recall hearing the judge saying that she wanted to keep what little space was left available open for those who REALLY "deserved" to be in there (convicted murderers, child molesters, etc.).

Last I checked, Dave is a partner. So while he also takes cases, he's pretty high up in his firm. I'm pretty sure a large percentage of his salary comes from that.

David knocked him out with a baseball bat and had him shipped to somewhere in Mexico. Then there, he was held as a hostage with a group of people, including some Russian mafia gang members. He was then liberated by a ragtag group of Russian Mercenaries. During this time he became good buddies with the Russian mafia, so they offered to take him back home to show the scenes.

During his time in Russia, he met up with a Japanese director of the Space Midget Horror, who was awestruck by his abs. So he cast him as the supporting actor. Being a realistic type of guy wants to shoot the film on the Moon. And he is asking the Ruskies for help.

That's right, LS began the story in some dirty washroom in New York with a bloody nose.... now he is heading to the Moon, to shoot a Japanese movie with a group of midgets. :awesome:

I really dont remember ever seeing anything about that process at all in this thread and as I said, I was reading up here pretty much daily.

Hmm...I see the issue. You are saying DA as in Defense Attorney apparently, not DISTRICT ATTORNEY (which is what I meant and what anyone in law enforcement would mean by that). Yeah, defense attorneys are the ones who make the money...but I thought that when the whole issue of you telling Jason that David was "in law enforcement" you said David was a prosecutor.

Also, make no mistake, the jails and prisons here are VERY overcrowded as well. In fact, I remember seeing some study that said Georgia has one of the highest percentages of its citizens in jail or prison.

Nah...another mod is not going to moderate me--especially without me being aware of it--on my thread and in my forum. It just doesn't work that way. In terms of displays of ultimate powah, we kinda cancel eachother out, if you know what I mean. I think Katie is on to it...it's gotta be some sort of glitch. But I'm pissed off because I typed a lot of s*** on those reports and no one even copied them in their replies...which means they are lost forever.
