If the cops thought she was a prostitute then why didn't they cuff or ask her husband for his ID as well as he would be a suspect for soliciting sex?

Her husband was right there as well.
 
They did ask for his ID and he gave it to them. She didn't because she felt they had not right to ask for it. Then, they detained her to figure out who she was.
 
Well if he was the driver then he had no choice but to give them ID.

The passenger usually isn't asked for ID unless he or she was involved in criminal activity which she wasn't.

Anyone who would dismiss it because of this incident with an unknown actress (lol @ "fame card") was going to dismiss it no matter what.

Is there any proof that they were having sex though? I also wonder how they can still arrest her for refusing to give her ID when there is no evidence of the crime. All they have from what I gather are some witnesses saying that they were having sex, so there isn't a crime taking place from what I'm hearing. If it's a law where they are then the cops were in the right, but I still don't get detaining someone just because they won't give you their ID when the cops don't have a crime they see you committing.

Damn it's hard being on a TMZ website hearing this ****. Can't believe that I'm giving them clicks. :csad:

It doesn't matter if she doesn't have ID or not. California is not one of the states that have a "Stop and identify" law, which gives the police the right to detain if a person doesn't identify themself. What the cops did was technically illegal.

The California Peace Officers Legal Sourcebook said:
The California Peace Officers Legal Sourcebook ("CPOLS"; written by the office of the California Attorney General) maintains that failure to identify oneself does not constitute a violation of California Penal Code §148(a)(1), resisting, delaying, or obstructing a peace officer: Unlike Nevada and 20 other states, California does not have a statute mandating that a detainee identify himself, and that obligation cannot be read into Penal Code Section 148. (Rev. 1/08, p. 2.14a)

Has that changed? The CNN reporter said cops are allowed to ask someone for ID if they feel the need to.
 
All I know is, the last time a cop asked for my ID, I showed it to him. Being in the right won't necessarily keep my black ass alive.
 
Either way, showing her ID and not walking away would've ended things as noted by the cop himself and how he treated her boyfriend.

I recommend against you doing the exact opposite (showing your black ass to keep your ID alive).

Incidentally, next time you can just show him your Hype avatar. A black guy who knows who Colin Baker is has a lower criminogenic profile than an 80-year-old Korean Mormon. In fact, theoretically your morphic field should also reduce the chances of crime happening around your general vicinity.

Interesting you said that. Here's what the ACLU says on the matter (this also predates the incident):

The prostitution aspect was what the boyfriend assumed. The cops didn't bring it up. They said they handcuffed here because she was preventing them from IDing her. Once they did, they let her go.

Well the cops didn't unlawfully put her in hand cuffs since that's the law. Sounds like she was ignorant of this, or she made a big deal out of it knowingly. I still hate hearing the cop says, "I'm a cop. You have to do what I say." Really? If a person isn't breaking any laws then the police shouldn't have that type of authority over someone. The fact that this guy says that just grinds my gears.

I think it varies. Some of us are very literal minded or are quick to react to anything we view as a slight.

Yes, that has happened: look up Amadou Diallo. I'm sure there are less publicized versions of the same thing.
