Even if he changed her memories she still happily complied so it's not rape by the proper definition, jack's rape comment was just a bit of melodrama the writers decided to put in in the hope of improving the episode.
 
Owen used a strange chemical substance to get a man and woman to have sex with him, against their wills. It's the same as drugging them, only this drug was airborne and inhaled.

But it is - we are dealing with future powers like these super sexy Pheromones and mind changing.

Even by the inate moral standards of a human being - they would not have complied if they were not exposed to these things.

It's abuse, which lead to rape. The woman does not have to be kicking and screaming and yelling NO!!! Just so it can be considered rape.

For gods sake the woman here are being manipualted beyond their own sane control into doing things against their will so they can not logicaly complt with anything.

You have to understand that their can not be any complying if they are under the strong influence of anothers drug or mind abiltiy.

It's that plain and simple.

- The man uses something to take away or hinder the woman free will
- Hence that woman can not comply under her own judgement.

It was an alien Pheromone as already stated the use of Pheromones does not (yet) count as rape, however there is some group trying to get all chemicals classed as pheromones outlawed although they aren't being taken to seriously due to the debate on how affective pheromones actually are. :o

Although it is ethically wrong, I am looking at it as a legal matter and victims didn't come under any of the categories that would allow the men you are calling "rapists" to be convicted of rape.

If there exists an alien with a natural body scent powerful enough to make any and every nearby human jump their bones, how do you supposed Torchwood got those pheromones off the alien, in the first place? Eww.

Actually she wouldn't of killed herself, the whole self preservation instincts thing and legally it would just be seen as him taking advantage of her whilst she was intoxicated, even if it is on a substance that makes her suggestible.

the only way you would even be able to start forming a case on this would be to say she was of an altered mental state, but really it was more fraud than rape.

Doctors having found traces of the drug/pheromone in the ladies body, like nothing we humans have seen before, tests run on it. Humans find out that all free will when expoused to this is basicly removed and the person who smells it wants to **** the person who wears it without control.

Then trust me the human race would class this pheromone as so powerful and dangerous that whatever man was found to have used it would be convicted in seconds.

Yes one could argue that all it does os hype up the sex drive - a natural urge......

But that is the whole problem with it. You are purposely changing and affecting someone to such an extent that it makes them totaly unable to reason or use correct judgement.

Which is a legale case. Couple with the evidence that the substance is stronger than using a date rape drug or alchol it would be a legal case.

You must understand that logic.

I ended up watching the episode after

Owen comes back the a glove Jack got the one they had in season 1 which brought you back from the dead. So with Own his like the undead, his alive but he doesn't have a heart beat, he can't eat or drink, none of his organs work - But I'm gutted I wanted him to stay dead
 
Martha was better, you say? I had a feeling she'd take a turn for the better if she wasn't constantly trying to hump the Doctor's leg.
