No... He's 39/40 in TDKR. He celebrated his 30th birthday in BB and TDK was a year (more or less) later so that makes him 31/32. TDKR is 8 years later so that makes Bruce 39/40. Bale is 37 right now (38 when TDKR arrives next year) so it's pretty close.

It could be, but I think they're just telling the audience that time has passed since TDK. Bruce is older now, and it is clear with the grey.Fine. Low and behold, they created a pretty awesome new character in Terry McGuiness who we all very quickly accepted as Batman due to his phenomenal introduction, backstory, and characterization.
Nolan could quite easily due something similar in his movie. And, much like all of his other changes he made (facepaint Joker, having both Two-Face and Joker in one movie, etc), after the fact we'll realize what was dumb was our original assumptions.
I'm not saying I think it'll happen, but on the off chance Nolan does go the route, I'm fully confident he'd do it in a thoroughly logical and original way that is anything but offensive.
