Let me put it to you this way.

My mother was not a good mother to her children. She's trying to compensate for that through her grandson, my nephew.

So yes, she would have charged me, but not him.

Even if she called the cops.. they wouldn't charge you with anything based on just your mothers words. Especially if she didn't even see it happen. Theyd have to talk to both of you, and I doubt would really do anything more than they did when you called.

Because my mom is the owner of the house, it is up to her to decide whether or not charges get laid. This is why my nephew didn't get charged, because my mom refused to do so. That is according to the cop.

It wouldn't be an assault charge, just from her though. There's no way she could charge either of you with assault.. Maybe with some kind of disturbance or fighting on her property. But it wouldn't be an assault charge without one of the people involved wanting it.

According to the cop, it was up to the homeowner to press charges. I had made my wishes perfectly clear on the issue at the time. Since my mom declined, there was nothing that I could do.
