I also liked the idea that since he's an arms dealer, he might have the means to have an umbrella capable of firing perhaps only a single round. He wouldn't have a whole bunch of crazy umbrellas, just the one which could fire one shot. I dont think that'd be too corny, do you? He doesn't need flamethrowers and hypnotizing umbrellas, just a single shot he can spring on an unsuspecting Batman who thinks he's disarmed.

You can easily solve that by having the "Penguin" be a coined nickname, given to him by his peers, which he happens to hate. Tons of real-life mobsters preferred their real names, only to be called a certain nickname behind their back.

He likes to look good, considers himself a high-society sort. He's more polite and more cultured than the average mobster, but still a mobster. Maybe he even has a fondness for birdwatching. So the other guys think he's sort of a dork, and they call him "The Penguin," and he hates it. To his help, he's Mr. Cobblepot. To his friends he's Oswald. To the wiseguys, he's The Penguin.

Bingo. You just summed it up. I really don't understand why so many people think Penguin is so hard to do in a realistic take--and even the realism, I think, has been taken overboard here. If I understand correctly, it's about making the why realistic. If you can pull off the why, the what (any given comic book element) can go in. If you can't give a decent explanation for something happening, they'll leave it be. That's my understanding.

It's not so, much that it's hard to make the character realistic, it's making him realistic, and keeping the ideals of the character, I mean just making him a short, fat, balding, British arms deal, (maybe with a big nose) wouldn't really be the penguin

Maybe Nolan is telling the truth and "The Penguin" isn't in the movie. That doesn't mean Oswald Cobblepot can't be in the movie. Like Keyser and Crooklyn were saying, Cobblepot the mobster could have significant screen time, but the Penguin (at least how the mainstream audience percieves him) will be nowhere near the film.
