I guess Activision realized. That they would lose this case

UPDATE: 2:27 PM: Activision has confirmed the settlement, saying that the terms are strictly confidential.

In a statement sent to the press, Activision dropped a bit of a clue as to the amount of the settlement:

"The company does not believe that the incremental one-time charges related to the settlement will result in a material impact on its GAAP or non-GAAP earnings per share outlook for the current quarter or the calendar year, due to stronger-than-expected operating performance in the current quarter.

Original Story: There will be no trial in the Activision Vs. West and Zampella case. According to a tweet from journalist Mike McWherton, the case has been resolved.

"No trial happening in West v. Activision suit. No comment from lawyers yet but case has been resolved," McWherton tweeted.

According to West and Zampella's lawyer, dismissals will be filed soon.

The settlement brings to an end the legal case that began in March of 2010, and revolved around the employment of Call of Duty creators Jason West and Vince Zampella. I totally forgot about that s***. I don't really care about the CoD franchise in general, though.
 
The CoD franchise is something Activision intends on destroying, like the Tony Hawk series.
 
Yeah, I'm right there with you. That's why I'm keeping a close eye on what Respawn, Bungie, and Blizzard are doing with their secret projects.
 
With every popular thing there's always a backlash, hence why Sci-Fi shooters got overtaken by "Realistic" Military shooters.
 
So how much money does Microsoft throw at these companies to get DLC first?
 
It makes a big deal for those who own multiple systems I think.
 
Maybe to some but a complete waste to me (I own all systems but don't really play them all regularly any more). I shouldn't really care but it just annoys me when they announce it thinking they've got some kind of trump card. Your actual permanent exclusives are trump cards. People who play more than one game will just play any of the other 100 top games till the DLC becomes available. The only guys I would see caring are those who play CoD exclusively and want the map packs but surely they are system locked anyway so they don't really have the option to change unless they want to play with a new controller, ditch whoever they used to play with and dump all their old stats etc.
 
It makes me not want to buy the game in the first place. And I feel like the developers are punishing me for not owning their favorite system.

Thats a pretty dumb way to look at it. The devs/publishers dont care about these systems. They care about who cuts the biggest check.
 
Yep. It's not about "favorites" at all.

You guys ought to put a positive spin on it and think they're doing you a favor in a roundabout way. You get to wait and see if the content is any good or not, if it's worth the price, etc.

Haha, im not, I'm just saying, these publishers ONLY see $$$. Thats it.

I still dont see why one would consider not purchasing a title only because the publisher is holding back DLC for X amount of time on X system. I mean think of it from the publishers perspective. MS just handed you 50K and all you gotta do is wait a bit before releasing your DLC on another's platform. Thats it. Its a a decision any one would make in a heartbeat. This IS a business after all.
 
I know. If they can wait to release DLC, I can wait to buy their game cheaper. :o
