You're right. You are taking this way too far. And honestly, just hypothetically, if Marc Webb never saw TDK, someone at Sony would have seen it and would have made sure they don't have that many similarities.Say Marc Webb had never seen TDK. And he had the idea to have Green Goblin terrorize new york, possibly just for the fun of it. Then in his rampage, he causes an accident at Oscorp and Gwen is killed. The same accident turns Max Dillon into Electro, who wants revenge on all those responsible, including Spider-Man and the police commissioner...

extremely irrational though they may be, you have obviously come across MANY who are making that/those irrational comparison(s). MANY of whom are die hard fans of comics, batman, spider-man, film in general, etc. Therefore its obviously on many people's minds. Its true the film makers shouldn't let previous films influence their decisions. But then why haven't we seen more carbon copies of TDK and other well made films in the genre? After all, if they did it right before, why fix what isn't broken?
They have to separate themselves from the pack, to keep us interested, entertained and keep our wallets lubricated. So if they decide to avoid something used by a previous film in the genre, kudos. I, for one, like to see new things.
Its obsurd. Not only another film, but a film from a completely unrelated franchise that was made over 4 years ago (will be 6 years by the time TASM2 comes out, 8 for TASM3).*cough cough skyfall*

good point about Skyfall. While still a good movie, I definitely got that vibe as well. Now if it had come out before TDK? who knows...
And you're right. Not killing off a character because another film did it is beyond ridiculous. But we are talking about killing off the primary love interest in film 2 to replace her with a more publicly known love interest in film 3. And stalling the death of gwen stacy for that reason (among others*) is indeed a sound plan, imo.
*Other reasons including Emma Stone's value and talent as an actress. Wanting to see more development between her and Peter. Green Goblin needing to be the one to kill her. The doom and gloom already surrounding ASM with the deaths of two major innocent protagonists in one film.
Think about it this way. We already had a member of the Stacy family die at the end of TASM, which caused Peter to feel extremely guilty. Does it make sense for such a similar ending to take place in TASM2? Not at all.
They'll wait for TASM3, if they're smart. Shock everyone (who doesn't know she's gonna bite it) by killing Gwen off early in the film, a la Janet Leigh in Psycho. Killing off the "star" so early on would be awesome, IMO.
