If they weren't allowed to use him they wouldn't have had the LoA.
Besides Neal Adams (the guy who created Ra's) and Kevin Smith talked about it together and they both talked about it as a fact and not speculation.
As for Kord they name dropped him once or twice subtly. With Ra's they had Moira name dropping him.

The LOA and Ra's are two different things. Ra's is an individual and the LOA is composed of various people 
Lest look at the facts here : they teased Batman/Bruce Wayne in the Flash pilot but DC confirmed that they cannot use him. In Arrow, they teased Ted Kord but the producers on Arrow confirmed that they cannot use him hence why they are using Ray Palmer now. DC just confirmed today that they have other plans for Ted Kord (Batman V Superman ? )And Harley Quinn was just an easter egg according to the producers.

Kevin Smith is not a reliable source. That guy is now known for misleading people since that fake Batman V Superman script story. He playing with people. It would not surprise me if he is using his show to mislead people.

There is name teasing and then there is what they did with Ra's al Ghul. They didn't just tease his name, the shouted it from the rooftop with a megaphone and then had a plane write it in the sky.
