i think the first scene with batman in TDK will be something like that. you will have some thugs doing somethign bad and than batman will come from the shadows.

Nolan hasn't said anything, but asking that question is askin to asking if Superman will fly in the next film. :P Of course Batman is gonna use feat to make his 'monster' even more infamous among Gotham's worst.

One of the casting sides had a bad guy getting scared because of the BATSIGNAL in the sky. It's safe to say Batman will still be putting the fear of god into Gotham's criminal underworld.

Scarecrow is someone we won't know is in or out until we see the film. My guess is he won't be in it, as much as I would like to see him.
