No Bane (I'd rather have him not appear at all than become some ******ed lackey) If Nolan has stuck this close to source material thus far with the villains, why would he repeat what Schumacher did to Bane? That's not Bane, and that's now how Nolan would do it, judging from his use of the past four villains.
No Freeze (luv the guy, but can Nolan really make him work?) Not too hard... An obsessive, manic-depressive scientist that uses a liquid nitrogen or thermite sprayer.
No Harlequinn (what would the point of her be in the movie if Mr. J ain't appearing.) Although I agree that she'd likely be more interesting if Joker were with her, part of me also thinks that she could be morphed into a criminal that is just as deranged, sick, and terrifying as Ledger's Joker under the guidance of Nolan.
Mad Hatter..... well he is a bit of a child molester. No Mad Hatter. While I think that the child molestation isn't a reason to keep him out, overall, Mad Hatter is just some dude who thinks he's a character out of a book... So, with that, I don't like the character, and thus, don't care to see him in this series.
Ivy, doesn't fit in well in Nolans universe.
