It's been talked about a lot over on Blu-ray.com. Lucas paid for 1,2,3,5,6 with his own cash. Twentieth Century Fox paid for ANH. Because of this Fox owns ANH outright. Thats why Disney couldn't purchase it from Lucas. If Disney wants ANH they will have to buy it from Fox and Fox is highly unlikely to give up one of the most famous films in cinema history.
As for distribution, Fox holds the distribution rights for 1,2,3,5,6 until 2020. At which point the distribution rights will revert back to Lucasfilm and Disney. ANH however will remain with Fox because they actually own the film.
Due to some interstudio negotiating Fox and Disney have worked some deal out that allows Disney to release 1,2,3,5,6 digitally through Disney's Movies Anywhere service. ANH however is the only one of the 6 that wasn't released on Disney's Movies Anywhere service. It's digital version doesn't carry the DMA tag, and it's not available on

As long as Fox and Disney continue to be cooperative with each other none of this should be a problem, but if Fox wanted to cause a stink or if Disney ever pissed Fox off Fox could refuse to allow Disneythe right to distribute ANH with the other films.
