How Fox operate regarding the rights is part of whatever distribution deal they struck with her company. Whatever transfer to Marvel, she's involved. Film rights are rights under copyright law to produce a film as a derivative work of a given item of intellectual property. Even this quote from an article in 2017 recognizes:

Faulty comparison. JJ Abrams production company never bought the film rights to Star Wars that I'm aware of so it never would have been "in control of the franchise".
Film distributors are responsible for marketing, advertising, physical production of release prints, etc. That's why production companies secure a distributor. Donner's company bought the FILM rights in 1994 and negotiated a deal with Fox pertaining to FILM. The details of the deal are not public. Donner's company didn't have control over any rights pertaining to merchandising, etc.Fox doesn't simply distribute the X-Men film series on behalf of the Donners' Company. 20th Century Fox Film Studio controls the character rights, physical production, marketing and advertising along with distribution.

I'm assuming that's the deal her company was involved in since she was working for Fox.This is a complete load of hooey, and can be proven wrong with a simple reading of the decision from the US Second Court of Appeals back in 2002 regarding the Mutant X Lawsuit:
The 1993 Agreement. Another bit of proof that you are wrong is that Disney would have been obligated to disclose any third party arrangement that could potentially have negatively impacted the Marvel rights set to transfer in the Fox buyout. To not disclose this apparently non-public (and totally imaginary) deal would have been a breach of The Walt Disney Company's fiduciary duty to their shareholders.
