Not sure it would matter either way. you wouldn't be able to market Dark Pheonix in the same way you market Deadpool.

You can market Deadpool in a fun way but chances are they may wanna market Dark Phoenix differently and not in a kinda hey look at this image of Cyclops and a unicorn!.

How are they illegally using her photo? they haven't posted that image from that one Instagram page.

If you mean her profile image then its likely it would be the other way round and someone else is using her photo.

It doesn't scream dark pheonix to me. the steel font seems abit random.
